Terms and Conditions for Divya Kripa App

Please read these terms and conditions carefully before using Our Service.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.

Introduction

Welcome to Divya Kripa (the “App”), designed and developed by Inspire Apps – a unit of RN & Sons (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of the App and its services. By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using the App.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of these Terms and Conditions:

  • “Application” means the software program, named Divya Kripa, provided by the Company downloaded by You on any electronic device
  • “Application Store” means the digital distribution service operated and developed by Google Inc. (Google Play Store) or Apple Inc. (Apple App Store) in which the Application has been downloaded.
  • “Affiliate” means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • “Account” means a unique account created for You to access our Service or parts of our Service.
  • “Company” (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to RN & Sons.
  • “Country” refers to India.
  • “Content” refers to content such as text, images, videos, documents, or other information that can be posted, uploaded, linked to or otherwise made available by You, regardless of the form of that content.
  • “Device” means any device that can access the Service such as a computer, a cell phone or a digital tablet.
  • “Feedback” means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of our Service.
  • “Service” refers to the Application or the Platform or its features.
  • “Terms and Conditions” (also referred as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
  • “Third-party Content” or “Third-party Social Media” Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
  • “You” means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

User Accounts

Account Creation: 

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.

Account Security: 

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password, whether Your password is with Our Service or a Third-Party Social Media Service.

You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.

Impersonation:

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

User Content

Your Right to Create or Post Content

Content Submission

Our Service or The App allows users to create or upload content, including text, images, and videos (“User Content”). You are responsible for the Content that You post to the Service, including its legality, reliability, and appropriateness.

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sub-licensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the App. You retain any and all of Your rights to any Content You submit, post or display on or through the Service and You are responsible for protecting those rights. You agree that this license includes the right for Us to make Your Content available to other users of the Service, who may also use Your Content subject to these Terms.

The license can also be used for the purposes of:

  • Promoting and marketing the App and its services.
  • Acquiring new users and facilitating transactions within the App.

This license includes the right to incorporate Content into promotional materials, advertisements, and other marketing initiatives related to the App or the Services.

Content Standards

You represent and warrant that your User Content does not infringe any third-party rights, including intellectual property rights, and does not violate any applicable laws or regulations. You represent and warrant that: (i) the Content is Yours (You own it) or You have the right to use it and grant Us the rights and license as provided in these Terms, and (ii) the posting of Your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

Content Restrictions

The Company is not responsible for the content of the Service’s users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under your account, whether done so by You or any third person using Your account.

You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable.

Monitoring and Removal

We reserve the right, but are not obligated, to monitor, review, or remove User Content at our sole discretion. The Company reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with this Terms, refuse or remove this Content.

The Company further reserves the right to make formatting and edits and change the manner of any Content. The Company can also limit or revoke the use of the Service if You post such objectionable Content. As the Company cannot control all content posted by users and/or third parties on the Service, you agree to use the Service at your own risk.

You understand that by using the Service You may be exposed to content that You may find offensive, indecent, incorrect or objectionable, and You agree that under no circumstances will the Company be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of any content.

Content Backups

Although regular backups of Content are performed, the Company does not guarantee there will be no loss or corruption of data. Corrupt or invalid backup points may be caused by, without limitation, Content that is corrupted prior to being backed up or that changes during the time a backup is performed.

The Company will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of Content. But You acknowledge that the Company has no liability related to the integrity of Content or the failure to successfully restore Content to a usable state. You agree to maintain a complete and accurate copy of any Content in a location independent of the Service.

Links to Other Apps / Websites / Third Party Services

Our Service may contain links to third-party applications, web sites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither the Company nor any of the company’s provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

Disclaimer on “Aaj Ke Darshan” Content

  1. The “Aaj Ke Darshan” feature on the Divya Kripa platform is intended to provide users with the latest available darshan visuals or updates from the respective temples.
  2. While every effort is made to ensure that the darshan content is up-to-date and accurately reflects the current day’s darshan, there may be instances where:
    • The visuals or updates represent a recent but not same-day darshan due to technical, logistical, or other unforeseen constraints.
    • The content is based on previously captured or shared materials provided by temple authorities or other sources.

Limitations of Real-Time Accuracy

  1. The platform does not guarantee that “Aaj Ke Darshan” will always reflect live or same-day visuals.
  2. Users are advised to verify the date and time of the darshan visuals, if critical, before relying on them for spiritual or personal purposes.

Responsibility and Reporting

  1. Divya Kripa relies on the temple authorities and other sources for darshan content. We are not liable for any discrepancies, inaccuracies, or misrepresentation of the darshan details.
  2. Users are encouraged to report any issues or concerns about the “Aaj Ke Darshan” content through the provided support channels for prompt review and correction.

The information provided on our platform is sourced from various third-party providers, users, and publicly available data. While we strive to ensure the accuracy, authenticity, and completeness of the content, we do not guarantee or warrant the same. Some of the content may be protected by intellectual property rights (IPR) of third parties, and its inclusion on our platform is for informational purposes only. The views, opinions, and factual representations made by users or third parties are their own and do not necessarily reflect our views or positions.

The content sourced from third-party providers, including but not limited to text, images, videos, and other materials, remains the property of their respective content owners or intellectual property rights (IPR) holders. Acknowledgments


While we make reasonable efforts to acknowledge and credit third-party content to its rightful owners, there may be instances where such acknowledgments are inadvertently missed. This is unintentional, and we are committed to rectifying any oversights. No Representation of Ownership


We expressly disclaim any representation or implication that third-party content displayed on our platform is owned by us. All trademarks, logos, and other proprietary content featured on our platform are the property of their respective owners.

Omission of permissions

In this App / Service, we have tried to make the access to temple information, darshan and visits easier by providing detailed data and media. The data and content has been added by multiple persons and different sources including computer generated resources.

While we do not want to publish copyrighted or private data, given the multitude of data sources, there might be chances that some data / information is copied or is from unintended sources and we may not have due / necessary permission for the same. We regret any such instance and apologize to the creators / owners of such content and kindly request to notify us at divyakripa@divyakripa.com  promptly of such issue/s so that we can remove the same from our platform immediately.

Further, the App / Service allows user generated content in forms of data, images, videos and comments, suggestions which may have third party rights over such content. We, Divya Kripa, Inspire Apps, RN & Sons, and the company / firm or any of its associates do not take any responsibility for correctness or validity of such content. Further, we are not liable for any loss, damages or harms caused to a user / users or any party consequent to the content or actions thereupon. This may have also led to inadvertent inaccuracies or factual errors and we request to intimate us at divyakripa@divyakripa.com about the same so as to rectify the same.

Indemnity


By using our platform, you agree to indemnify and hold harmless Divya Kripa, its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney’s fees) arising from:

  • Any use of IPR-protected information without appropriate authorization.
  • Any inaccuracies, omissions, or misrepresentations in the content provided.
  • Any disputes arising from third-party or user-submitted content.

Reporting and Removal Policy
If you believe that any content on our platform infringes your intellectual property rights or contains factually incorrect or misleading information, please bring it to our attention immediately. We are committed to addressing such concerns promptly. You may report such content by contacting us at divyakripa@divyakripa.com

Upon receiving a valid notice, we will review the matter and take appropriate action, including content removal, as necessary.

Use of Divya Kripa Platform

You understand that except for information, products or services clearly indicated as being supplied by Divya Kripa, we do not operate, control, or endorse any information, products or services on the Internet in anyway. You also understand that Divya Kripa cannot and does not guarantee or warrant that files available for download through the Divya Kripa Platform will be free of viruses, worms or other code that may be damaging. You are responsible for implementing procedures to satisfy Your particular requirements of Internet security and for accuracy of data input and output.

Prohibited Conduct

By accessing or using the Divya Kripa Platform or by availing Divya Kripa Services, You agree not to:

  • violate the T&Cs;
  • impersonate any person or entity, falsely claim or otherwise misrepresent Your affiliation with any person or entity, or access the accounts of others without permission, forge another person’s digital signature, misrepresent the source, identity, or content of information transmitted via the Divya Kripa Services, perform any other similar fraudulent activity or otherwise avail Divya Kripa Services with what we reasonably believe to be potentially fraudulent funds;
  • infringe our or any third party’s intellectual property rights, rights of publicity or privacy;
  • post or transmit any message which is libellous, defamatory or which discloses private or personal matters concerning any person;
  • post or transmit any message, data, image or program which is pornographic, vulgar or offensive in nature;
  • refuse to cooperate in an investigation or provide confirmation of Your identity or any other information provide by You to Divya Kripa;
  • remove, circumvent, disable, damage or otherwise interfere with security-related features of the Divya Kripa Services and the Divya Kripa Platform or features that enforce limitations on the use of the Divya Kripa Services or the Divya Kripa Platform;
  • reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of as regards Divya Kripa Services or Divya Kripa Platform or any part thereof, except and only to the extent this is expressly permissible by applicable law;
  • use the Divya Kripa Services or the Divya Kripa Platform in any manner that could damage, disable, overburden, or impair it, including, without limitation, using the Divya Kripa Services or the Divya Kripa Platform in an automated manner;
  • modify, adapt, translate or create derivative works based upon the Divya Kripa Services and the Divya Kripa Platform or any part thereof, except and only to the extent that that this is permissible by applicable law;
  • intentionally interfere with or damage operation of the Divya Kripa Services or the Divya Kripa Platform or any other user’s enjoyment of it, by any means, including uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code or file with contaminating or destructive features;
  • use any robot, spider, other automatic device, or manual process to monitor or copy the Divya Kripa Platform without prior written permission;
  • interfere or disrupt the Divya Kripa Platform or networks connected to the Divya Kripa Platform;
  • take any action that imposes an unreasonably or disproportionately large load on Divya Kripa’s infrastructure/network;
  • use any device, software or routine to bypass the Divya Kripa Platform’s robot exclusion headers, or interfere or attempt to interfere, with the Divya Kripa Services;
  • forge headers or manipulate identifiers or other data in order to disguise the origin of any content transmitted through the Divya Kripa Platform or to manipulate Your presence on the Divya Kripa Platform;
  • sell the Divya Kripa Services, information, or software associated with or derived from it;
  • use the facilities and capabilities of the Divya Kripa Platform to conduct any activity or solicit the performance of any illegal activity or other activity which infringes the rights of others;
  • breach this Agreement, or any other agreement or policy as may be applicable pursuant to the T&Cs;
  • provide false, inaccurate or misleading information;
  • use the Divya Kripa Platform to collect or obtain personal information, including without limitation, financial information, about other users of the Divya Kripa Platform, except and only as expressly provided in the T&Cs;
  • avail Divya Kripa Services with what Divya Kripa reasonably believes to be potentially fraudulent funds;
  • use the Divya Kripa Services in a manner that results in or may result in complaints, disputes, reversals, chargebacks, fees, fines, penalties and other liability to Divya Kripa, a third party or You;
  • use the Divya Kripa Services in a manner that Divya Kripa or any payment card network reasonably believe to be an abuse of the payment card system or a violation of payment card network rules;
  • take any action that may cause Divya Kripa to lose any of the Divya Kripa Services from its service providers or lose any of its recharge partners or business partners, including mobile operators or telecom companies, payment processors or other suppliers;
  • send automated request of any kind to the Divya Kripa Platform without express permission in advance from Divya Kripa.

Transactions – Purchases and Subscriptions

Purchases

The App may offer in-app services or offerings for purchase. All purchases are final and non-refundable, except as required by applicable law.

Subscriptions

If the App offers subscription plans, the terms of the subscription, including billing cycles and cancellation policies, will be provided at the time of subscription.

Role as an Enabler

Our platform serves solely as an enabler for connecting users with various service providers, including but not limited to donation services, temple offerings, or other related transactions. We facilitate these interactions for user convenience but do not directly manage or oversee the monetary transactions or services provided by third parties.

No Responsibility for Transactions


We do not assume any responsibility or liability for:

  • The accuracy, pricing, or availability of services offered by third-party service providers.
  • Any loss, deficiency, delay, or non-fulfillment of services or offerings purchased or donated for through the platform.
  • Errors, omissions, or discrepancies in the transactions or services facilitated via our platform.

Independent Relationship


All transactions and donations are direct engagements between the user and the respective service provider or beneficiary. The terms, conditions, and obligations governing these transactions are independent of our platform, and we are not a party to such arrangements.

No Warranty or Guarantee


We make no warranties or guarantees, expressed or implied, regarding the quality, delivery, or suitability of the services or offerings provided by third parties through our platform.

Dispute Resolution
In case of any dispute or grievance arising from transactions or donations made through the platform, users are advised to contact the respective service provider or beneficiary directly for resolution.

Fraudulent or Unauthorized Transactions
Users are encouraged to exercise due diligence while making payments or donations. We are not liable for any fraudulent or unauthorized transactions conducted through our platform.

Limitation of Liability and Damages

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the App.
  • Any unauthorized access to or use of our servers and/or any personal information stored therein.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or Rs. 100  if You haven’t purchased anything through the Service.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.

In no event, Divya Kripa, its Principal/s or its associates, contractors, agents, licensors, partners or suppliers will be liable to You for any special, indirect, incidental, consequential, punitive, reliance, or exemplary damages (including without limitation lost business opportunities, lost revenues, or loss of anticipated profits or any other pecuniary or non-pecuniary loss or damage of any nature whatsoever) arising out of or relating to the App, the Service or any part related to it.

Feedback and Suggestions

By providing feedback or suggestions to us, you agree that we may use such feedback or suggestions without any obligation to compensate you.

You assign all rights, title and interest in any Feedback You provide the Company. If for any reason such assignment is ineffective, You agree to grant the Company a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.

Promotions and Contests

From time to time, we may offer promotions or contests. Such promotions or contests will be governed by separate terms and conditions provided at the time of the promotion or contest.

Intellectual Property Rights

All content and materials available on the App, excluding Third Party Content and User Content, are the property of the Company or its licensors and are protected by intellectual property laws. You agree not to reproduce, distribute, or create derivative works from any content without our prior written consent.

We respect the intellectual property rights of others. It is Our policy to respond to any claim that Content posted on the Service infringes a copyright or other intellectual property infringement of any person.

Indemnification

You agree to indemnify and hold harmless the Company, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Survival

Upon termination of this Agreement, any provision which, by its nature or express terms should survive, will survive such termination or expiration as applied to transfers and relationship prior to such termination or expiration.

Termination

We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service.

Headings

The heading references herein are for convenience purposes only and they do not constitute a part of these T&Cs and will not be deemed to limit or affect any of the provisions hereof.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any changes by posting the new Terms on the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the application and the Service.
