If you’re an Editor or Admin or have edit rights for the App / the Service or Divya Kripa, following additional terms and conditions, along with standard Terms and Conditions (Terms App) are applicable to you.
Information
Accuracy and Timeliness of Information
As a Entity / Third-party administrator using our platform, you are solely responsible for ensuring that all information provided, including but not limited to service details, pricing, schedules, offerings, and other relevant content, is accurate, complete, and up-to-date at all times.
Regular Updates
You are required to regularly review and update the information associated with your profile or services to maintain its accuracy and relevance. Failure to do so may result in user dissatisfaction, complaints, or removal of your listing from our platform.
Accountability for Errors or Omissions
Any errors, omissions, or outdated information that result in disputes, user inconvenience, or other liabilities shall be your responsibility. We shall not be held liable for any issues arising from inaccuracies or misrepresentation in the information provided by you.
Platform Rights
We reserve the right to:
- Monitor and review the content provided by third-party admins.
- Request corrections or updates to inaccurate or outdated information.
- Suspend or terminate your access to the platform if the provided information is consistently inaccurate or misleading.
Commitment to Transparency
By using our platform, you agree to maintain transparency and act in good faith to provide accurate and timely updates for the benefit of all users.
Administrator Authorization
Representation and Authorization
By registering as an administrator on our platform, you confirm that you are a duly authorized and bonafide representative of the entity, organization, or service you are managing. You affirm that you have the necessary authority to act on behalf of the said entity and to provide, update, or manage information and services related to it and have the legal right to grant this authorization.
Proof of Authorization
We reserve the right to request proof of your authorization to act on behalf of the entity you represent. This may include, but is not limited to, official letters of authorization, identity verification, or other relevant documentation. Failure to provide such proof upon request may result in suspension or termination of your access to the platform.
Accuracy of Representation
As an authorized representative, you agree to ensure that all information and services managed on behalf of the entity are accurate, up-to-date, and in compliance with applicable laws and regulations. Any misrepresentation or unauthorized activity will be solely your responsibility and may lead to appropriate action, including legal consequences.
Indemnification
You agree to indemnify and hold us harmless against any claims, liabilities, or damages arising from disputes, misrepresentation, or unauthorized actions in connection with your role as an administrator.
Acknowledgment
By using our platform, you acknowledge and agree to these terms, affirming your role as an authorized representative with the authority to act on behalf of the entity you manage.
Explicit Authorization to Represent Temple Details and Services
Authorization to Represent and Enlist
By registering your temple or associated entity on the Divya Kripa platform, you explicitly authorize us and associated businesses to:
- Represent and display details about your temple, including but not limited to its history, significance, services, offerings, darshans, seva and other related information.
- Enlist your temple’s offerings, pooja services, and donation opportunities for the purpose of facilitating user engagement and interaction.
Authorization to Facilitate Transactions
You expressly authorize Divya Kripa to:
- Accept and process user bookings for temple-related offerings, pooja services, or donations on your behalf.
- Provide users with a seamless platform for conducting such transactions.
Revenue and Payment Handling
- You acknowledge that Divya Kripa acts as an intermediary to enable these transactions and does not assume ownership or liability for the services provided by your temple or associated entity.
- Any disputes regarding service delivery, pricing, or user dissatisfaction must be addressed by the temple or associated entity directly.
- The payment will be passed on to your enlisted bank account after 15 days of successful completion of the ordered services.
- You will need to rectify or take remedial measures in case/s of service deficiencies
- Payment will only be due upon receipt of confirmation from the user that the service has been satisfactorily delivered. In the absence of such confirmation, payment may be withheld until satisfactory resolution is provided.
- In case of service deficiencies, Divya Kripa reserves the right to deduct the amount, to the extent warranted, or withhold the payables to you.
Indemnification
You agree to indemnify and hold Divya Kripa harmless from any claims, liabilities, or disputes arising from:
- The representation of your temple’s details and services.
- Transactions facilitated by the platform on behalf of your temple.
Revocation of Authorization
You may revoke this authorization at any time by providing written notice to Divya Kripa. However, such revocation will not affect any prior transactions or ongoing commitments made through the platform.
Exclusivity of Authorization
Rights
- By availing of the free listing services provided by Divya Kripa, you grant us exclusive rights to represent and display your temple’s details, offerings, services, and related information on our platform.
- You agree not to authorize or collaborate with any other third-party platform for similar listing, representation, or booking services for your temple’s offerings, pooja services, or donations during the term of this agreement, without prior written consent from Divya Kripa.
Scope of Exclusivity
- The exclusivity extends to all digital updates, booking services, and promotional activities facilitated by the platform.
- This exclusivity does not restrict your temple from independently engaging with devotees or promoting services through your official channels (e.g., your website or social media).
- However, if Divya Kripa or its Principals find violation of exclusivity, you’d be liable to make a payment for the usage of the Service (the App or Divya Kripa) from the date when the exclusivity ceased to exist.
Benefits of Exclusivity
- Free listing of your temple, including detailed descriptions, high-quality images, and regular updates, to reach a wider audience.
- A dedicated digital space for showcasing your temple’s events, services, and donation opportunities, supported by regular updates from your authorized representatives.
- Continuous access to Divya Kripa’s tools and services to enhance your temple’s digital presence and engage devotees effectively.
- Free listing does not cover the charges incurred on or for enabling transactions. The same need to be paid by the entities receiving the payment unless Divya Kripa has already received the same from the users.
Termination of Exclusivity
- Either party may terminate this exclusivity agreement with 30 days’ written notice. Upon termination, all services and listings related to your temple on the Divya Kripa platform may be deactivated or will be provided on a chargeable basis.
- Any ongoing transactions or commitments made by users before termination will be fulfilled as per the platform’s terms.
Acknowledgment and Agreement
By accepting the free listing services provided by Divya Kripa, you acknowledge and agree to the terms of exclusivity as stated above. This ensures mutual benefits and effective collaboration between your temple and our platform.
